Resolution authorizing the City Engineer to execute a cost sharing project agreement for the reconstruction of W. Pierce St. between S. 76th St. and S. 77th St.

Body
WHEREAS, Wisconsin Statues Section 66.0301 authorizes any municipality to enter into an Intergovernmental Cooperation Agreement with another municipality for, among other things, the joint exercise of any power authorized by law; and,

Whereas, The street was constructed in 1959 and is in need of reconstruction; and

Whereas, The City of Milwaukee and City of West Allis share jurisdictional ownership of the street. The City of Milwaukee owns the north side and the City of West Allis owns the south side; and

Whereas, The City of West Allis will be the lead agency of the project design and construction; and

WHEREAS, the City of West Allis and the City of Milwaukee desire to enter into an Agreement to set forth their understanding with respect to the construction of the aforesaid public improvements; and

WHEREAS, On October 3, 2023 the Common Council approved the 2024 Capital Improvement Program, dated September 27, 2023, and approved the funding in R-2023-0664, and

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Agreement by and between the City of West Allis and the City of Milwaukee, a copy of which is attached hereto and by reference made a part hereof, for the installation of certain public improvements in West Pierce Street between South 76th Street and South 77th Street and is hereby approved.

BE IT FURTHER RESOLVED that the City Engineer is hereby authorized and directed to execute and deliver the aforesaid Agreement on behalf of the City of West Allis.

BE IT FURTHER RESOLVED that the City Engineer, with the approval of the City Attorney, be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the agreement as may be necessary and proper to correct incons...
