Resolution granting a Ten-Year Maintenance Covenant by the City of West Allis to Milwaukee Metropolitan Sewerage District (MMSD) to preserve the Green Infrastructure facilities on City Property.
Body
WHEREAS, the City of West Allis ("City") has agreed to grant to MMSD, a Maintenance Covenant, a copy of which is attached hereto and incorporated herein by reference, on the property located in the City and legally described in Exhibit "A" of the Covenant; and,
WHEREAS, MMSD is willing to accept all the terms and conditions of said Covenant; and,
WHEREAS, The purpose of this covenant is to ensure that the installed Green Infrastructure is maintained properly by the City of West Allis;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:
1. That the Maintenance Covenant between the City of West Allis and MMSD, which is attached hereto and incorporate herein by reference, be and the same is hereby accepted and approved.
2. That the City Engineer is hereby authorized and directed to execute the attached Maintenance Covenant on behalf of the City of West Allis.
