Resolution to approve a (3) three-year agreement, to renew annually after the initial term, for the single stream recycling processing services between Johns Disposal Service, Inc., and the City of West Allis.

WHEREAS, the City of West Allis ("City") has an Agreement with Johns Disposal Service, Inc. for processing services of recycling materials dated August 2017 to July 31, 2022; and,

WHEREAS, the Agreement will expire at 11:59 p.m. on July 31, 2022; and,

WHEREAS, the Department of Public Works submitted a Request for Proposal (RFP) for recycling and material processing (RFP #22-004); and.

WHEREAS, the Department of Public Works and City's Finance/Purchasing reviewed and evaluated responses from Waste Management, Inc. and Johns Disposal, Inc.; and,

WHEREAS, the Department of Public Works and City's Finance/Purchasing selected Johns Disposal Inc. for having the most advantageous proposal; and,

WHEREAS, the Department of Public Works and City's Finance/Purchasing has elected to pursue the term of the contract for three years (August 1, 2022, through August 1, 2025) to renew annually after the initial term; and,

NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of West Allis that the (3) three-year agreement, a copy of which is attached hereto and made a part hereof, be and is hereby approved, along with the RFP response dated May 25, 2022, and;

BE IT FURTHER RESOLVED the funding for these services are budgeted annually, and will be charged to the Solid Waste Fund, Account Number 550-4233-535.41-09, Dumping/Processing Fees.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Director of Public Works, with the approval of the City Attorney, be and is hereby authorized to make such substantive changes, modifications, additions, and deletions to and from the various provisions of the Agreement, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preser...
