Resolution to amend an existing Professional Service Contract with raSmith to provide construction management of private property improvements for an amount not to exceed $35,000.

WHEREAS, The Common Council passed resolution R-2019-0616 on September 3, 2019, an agreement with raSmith to provide construction management of private property improvements for an amount not exceed $327,750; and

WHEREAS, The remaining balance of said contract is approximately $95,000, which will cover the majority of the proposed work in 2022; and

WHEREAS, The Common Council passed resolution R-2022-0009 on January 11, 2022 authorizing an agreement for reimbursement from MMSD to fund the disconnection of foundation drains and sanitary lateral rehabilitations on all 2021 street reconstructions in an amount not to exceed $710,000; and,

WHEREAS, The City of West Allis will enter into an agreement with the Department of Natural Resources Principal Forgiven Financial Assistance Agreement in an amount up to $346,300 to undertake a project to replace private lead service lines; and,

WHEREAS, The Common Council passed a resolution R-2022-0311 on April 19, 2022 authorizing the bid approval of MJ Construction Inc. for Private Property Work.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Common Council of the City of West Allis that the proposal dated June 20, 2022 submitted by raSmith for furnishing Engineering Consulting Services to provide construction management of private property improvements for an amount not to exceed $35,000 be and is hereby accepted.  Funding for this purchase will be reimbursed through the MMSD Private Property Infiltration and Inflow Reduction Agreement No. M10005WE02 and through Special Assessments.

BE IT FURTHER RESOLVED that the City Engineer be and is hereby authorized to enter into a Professional Services Contract with raSmith.

BE IT FURTHER RESOLVED that the City Engineer be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the proposal from raSmith as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof and to protect the interests of the City, including but not limited to, any and all changes necessary to preserve the intent of the Common Council of the City of West Allis.
