Title

Resolution approving a 6-month extension of time to implement a proposed Community Based Residential Facility, to replace the existing vacant office building, located at 8410 W. Cleveland Ave.

 

Body

WHEREAS, Robert Chandler of Midwest Commercial Funding (property owner), duly filed with the City Clerk an extension of time for the development of a Community Based Residential Facility, to replace the existing vacant office building located at 8410 W. Cleveland Ave.; and,

 

WHEREAS, after due notice, the Common Council approved the special use permit on June 4, 2019 (R-2019-0370); and, an extension of time limitations may be granted without a public hearing by the Common Council; and,

 

WHEREAS, the property owner and their contractor have submitted the following information:

 

A.                     The applicant requesting the extension shall complete a planning application available from the Department of Development and shall submit a $250.00 extension fee.

 

B.                     A written explanation for the extension of time shall accompany the planning application along with a timeline/schedule for obtaining necessary permits, zoning, state and municipal approvals and a target date for construction start.

 

NOW, THEREFORE, BE IT RESOLVED that said extension of time is granted for a 6-month period. If the use has not commenced, if construction is not underway, or the owner has not obtained a valid building permit within 6 months from and after the Council approval of the grant of this extension, then the special use shall become null and void on June 15, 2021.
