Title

Resolution amending the existing professional services contract with AECOM Technical Services, Inc.  (ATS)  to provide consulting services relative to Wisconsin Administrative Code NR 216 Stormwater Permit compliance requirements for 2020 for an additional sum not to exceed $14,400

 

Body

 

WHEREAS, in 1996 the City of West Allis, in anticipation of the future need to comply with and fund various Federal Clean Water initiatives initiated an Request For Proposals (RFP) for consulting services to assist the City in determining the best approach; and,

 

WHEREAS, from the RFP's received, West Allis selected ATS (formerly Earth Tech Inc. and Rust Environmental) to perform the required services; and,

 

WHEREAS, the outgrowth of ATS's work was the development of the West Allis Stormwater Utility; and,

 

WHEREAS, during the development of the Utility ATS also provided consulting services in the preparation of the "Preapplication Stormwater Discharge Permit", required by Wisconsin Administrative Code NR 216.05; and,

 

WHEREAS, following the Department of Natural Resources approval of the preapplication, ATS assisted the City in the development of the NR 216 Stormwater Discharge Permit application; and,

 

WHEREAS, in 2004, the Wisconsin Department of Natural Resources issued a Wisconsin Pollutant Discharge Elimination System (WPDES) Stormwater Permit to the City of West Allis; and,

 

WHEREAS, in 2008 and in 2012, the Wisconsin Department of Natural Resources renewed the City of West Allis WPDES Stormwater Permit; and,

 

WHEREAS, in part, the permit sets forth a compliance schedule for implementing various programs and activities; and,

 

WHEREAS, ATS has continued to provide professional services relative to the City's Stormwater Utility and WPDES permit requirements for 2005 through 2019; and,

WHEREAS, ATS, will continue, in compliance with the permit requirements, to develop technical reports and implement monitoring programs required of the WPDES Permit for 2020; and,

 

WHEREAS, ATS, will expand the scope of the original agreement to include additional illicit discharge research and testing as requested by the City, in compliance with the permit requirements, for 2020; and,

 

WHEREAS, given ATS's comprehensive knowledge of and continued involvement with the City of West Allis storm sewer system makes it inappropriate to issue a request for proposals from other consulting firms.

 

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of West Allis that the  proposal dated April 27, 2020 for consulting services is hereby amended to provide the continuation of the same services as well as the additional services described in the amended scope of services in 2020, for a sum not to exceed $14,400, the funding of such services shall be paid by the City's Stormwater Utility.

 

BE IT FURTHER RESOLVED that the City Engineer be and is hereby authorized to enter into a Professional Services Contract with ATS.

 

BE IT FURTHER RESOLVED that the City Engineer be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the proposal from ATS as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof and to protect the interests of the City, including but not limited to, any and all changes necessary to preserve the intent of the Common Council of the City of West Allis.
