Resolution to approve a master lease agreement authorizing Cellco Partnership d/b/a Verizon Wireless to install small wireless facilities on City-owned utility poles

WHEREAS, Wis. Stat. § 66.0414(4)(e)1. requires the city to implement rates, fees, and terms for the collocation of small wireless facilities on governmental poles by October 1, 2019; and
WHEREAS, Cellco Partnership d/b/a Verizon Wireless has requested to collocate small wireless facilities on pole owned by the City; and
WHEREAS, the attached master lease agreement sets forth the rates, fees, and terms as required by law;
NOW, THEREFORE, BE IT RESOLVED that the attached agreement between Cellco Partnership d/b/a Verizon Wireless and the City of West Allis is approved.
BE IT FURTHER RESOLVED that the City Engineer is authorized to sign and execute all necessary documents for the completion of this lease.
BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such non-substantive changes, modifications, additions, and deletions to and from the various provisions of the agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
