Resolution to authorize the Director of Public Works to sign the Proposal for Professional Services, including a Standard Terms and Conditions Agreement, submitted by Baxter & Woodman Consulting Engineers for services to assist the City of West Allis in performing a Optimized Corrosion Control Treatment Study for the amount of $18,000 ordered by the Wisconsin Department of Natural Resources

WHEREAS, West Allis Water Works purchases treated water from Milwaukee Water Works; and,
WHEREAS, Milwaukee Water Works treats the purchased water with orthophosphate for corrosion prevention; and,
WHEREAS, the Department of Natural Resources (DNR) has been partnering with the state’s large water systems , including the City of West Allis (City) , to ensure the systems are optimizing their corrosion control treatment (CCT) by minimizing lead and copper concentrations in their drinking water to the greatest extent possible; and
WHEREAS, because the DNR has determined there currently is insufficient system specific information to determine whether the City’s existing CCT practices are optimized in a manner that minimizes lead and copper concentrations in the drinking water it has ordered the City to conduct a Demonstrative Corrosion Control Treatment Study (CCT Study) to evaluate the drinking water system and develop a report documenting how the City intends to minimize lead and copper in its drinking water system; and,
WHEREAS, the DNR has given a complete timeline for the requirements of the CCT Study, with October 31, 2019, being the first date by which the City must submit a proposal to the DNR outlining the basic steps/components of the study, the anticipated timeline for each step and any additional work completed to date; and,
WHEREAS, because of its complexity, the DNR strongly recommends the City work with a consultant and/or treatment expert to determine the best direction in conducting the CCT Study, using Environmental Protection Agency guidance documents; and,
WHEREAS, Baxter & Woodman Consulting Engineers (Baxter & Woodman) has submitted a proposal for this project that outlines its performance of three separate tasks - Task 1 and Task 2 involve the work required to prepare and preparation of the CCT Study and are covered by the funds requested herein ($18,000); Task 3 involves implementation of any required monitoring and/or offline testing based on the recommendations of the CCT Study report, the cost for which will be estimated upon the conclusion of Task 2 and is not included herein; and,
WHEREAS, the City has determined that Baxter & Woodman, whose professional staff have extensive prior experience with the City’s water system and who will work with a nationally recognized treatment expert, Process Research Solutions, LLC of Madison, as a sub-consultant, is highly qualified to assist the City with the completion of the study; and,
WHEREAS, the funds are available in account number 501-2706-537.44-54 due to a delay in the Reservoir Study project; and,
WHEREAS, the City Attorney’s Office has reviewed and made recommendations with respect to the agreement between the City and Baxter & Woodman for the performance of the CCT Study.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of West Allis that the Director of Public Works is authorized to execute the Baxter & Woodman Proposal, related to the completion of the CCT Study, in the amount not to exceed the proposed $18,000, upon approval of the terms thereof by the City Attorney’s Office.
BE IT FURTHER RESOLVED that the appropriate City officials are directed and authorized to fund this effort by making the appropriate transfer of budgeted water utility funds to the appropriate accounts and take whatever other actions are required to fund the work from the West Allis Water Utility.
