Ordinance to amend Section 6.027(2)(c) of the West Allis Municipal Code relating to the definition of a “Designated Offender”

The Common Council of the City of West Allis, Milwaukee County, do ordain as follows:
Part 1. Code Revision
Section 6.027(2)(c) of the Municipal Code of the City of West Allis is hereby amended to read as follows:
“Designated Offender” means any person who is required to register under s. 301.45, Wis. Stats., for any offense in which a Child was a victim, regardless of whether the offender victimized a specific Child or through images of a Child. This definition does not include a person who is released under s. 980.08, Wis. Stats., so long as the person is subject to supervised release under ch. 980, Wis. Stats., the person is residing where he or she is ordered to reside under s. 980.08, Wis. Stats., and the individual is in compliance with all court orders issued under ch. 980, Wis. Stats.
Part 2. Inconsistent Law Repealed
All ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed.
Part 3. Severability
The provisions of this ordinance are severable. If any provision of this ordinance is invalid, or if the application of this ordinance to any person or circumstance is invalid, such invalidity shall not affect other provisions or applications which can be given effect without the invalid provision or application.
Part 4. Effective Date
This ordinance shall take effect and be in force from and after its passage and publication.
