Title

Ordinance to amend Subsection 9.15(15) of the Municipal Code of the City of West Allis to allow for the use of pre-paid debit cards for certain payments by pawnbroker licensees to customers

Body

NOW THEREFORE, the Common Council of the City of West Allis, Milwaukee County, do ordain as follows:

Part I.                     Section 9.15(15) of the Municipal Code of the City of West Allis is amended to read as follows:

 

(15)                     For all transactions where a pawnbroker licensee pays a customer for an item where payment equals or exceeds $250, the payment shall be paid by check or prepaid debit card from the pawnbroker licensee to the customer. The pawnbroker licensee shall not thereafter cash said check and provide cash to the customer. A transaction may not be broken down in increments of less than $250 to avoid the requirements of this provision.

 

PART II. Inconsistent Law Repealed.  All ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed.

 

PART IV. Severability.  The provisions of this ordinance are severable.  If any provision of this ordinance is invalid, or if the application of this ordinance to any person or circumstance is invalid, such invalidity shall not affect other provisions or applications which can be given effect without the invalid provision or application.

 

PART V.  Effective Date.  This ordinance shall take effect and be in force from and after its passage and publication.
