WHEREAS, The Common Council of the City of West Allis believes that the following railroad crossings in the City of West Allis are in need of immediate repairs by replacement of the concrete panels:

1. W. Electric Avenue, U.S. DOT Crossing No. 177231Y at milepost 85.400 of the Milwaukee Subdivision at West Allis, Wisconsin.
2. W. Greenfield Avenue, U.S. DOT Crossing No. 177242L at milepost 86.868 of the Milwaukee Subdivision at West Allis, Wisconsin.
3. W. Beloit Road, U.S. DOT Crossing No. 177237P at milepost 86.020 of the Milwaukee Subdivision at West Allis, Wisconsin.
4. S. 68th Street, U.S. DOT Crossing No. 177243T at milepost 86.480 of the Milwaukee Subdivision at West Allis, Wisconsin.

WHEREAS, The Union Pacific Railroad Company is obligated by State Statute 86.12(1) to keep the surface of the crossings between the tracks and rails and extending 4 feet on either side of the outside rails, in good condition and repair for highway travel; and

WHEREAS, The concrete in the prefabricated concrete crossing panels has deteriorated and exposed holes approximately four to six inches in depth that pose a hazard for vehicles travelling over the crossings; and

WHEREAS, The City's Public Works Department made emergency repairs to the failing panels using temporary asphalt to fill the holes in the panels in 2019; and

WHEREAS, the Common Council of the City of West Allis has the authority to require Union Pacific Railroad Company to repair and improve the crossings by the authority of State Statutes 86.12(1).
