Resolution Authorizing the Retention of Outside Legal Counsel.

 

Body

WHEREAS, the City of West Allis (the “City”) has pending “dark store” tax assessment litigation; and

 

WHEREAS, there is a vacant Attorney position in the City Attorney’s Office; and

 

WHEREAS, to address the unique “dark store” litigation and other municipal legal issues that may exceed the Attorney’s Office workload capacity due to the vacancy, it is in the best interest of the City to retain outside legal counsel for the “dark store” litigation and other legal matters on an “as needed” basis; and

 

WHEREAS, the City Attorney’s Office recommends retaining the law firm of Stafford Rosenbaum LLP based on its notable experience and expertise acting as special counsel for many Wisconsin local governmental entities; and 

 

WHEREAS, the City Attorney salary account should provide sufficient funding for the retention of said outside legal counsel however, in the event additional funds become necessary, authorization for such will be sought from the Common Council.

 

NOW, THEREFORE, BE IT RESOLVED By the Mayor and Common Council of the City of West Allis that the Interim City Attorney be and is hereby authorized  and directed to enter into a retention agreement with Stafford Rosenbaum LLP for the purpose of handling the “dark store” litigation and other municipal legal matters as needed.
