Resolution authorizing and directing the Director of Public Works/City Engineer to enter into a rights-of-way and pole attachment agreement with Wisconsin Technology Networking, LLC.

Body
WHEREAS, Wisconsin Technology Networking, LLC (WITN), in partnership with Mobilitie, has requested to access portions of the public right-of-way and use the City's power or lighting poles to place communications services; and,

WHEREAS, the main points of the agreement are:
1) A ten year agreement term.
2) WITN is authorized to place antennas, radios, wireless microwave and other related communication equipment.
3) WITN is also authorized to install fiber optic cables, conduit, ducts, control boxes, vaults, poles, cables, power sources and/or other structures.
4) The City will receive a fixed permit fee of $500 for each pole WITN attaches to or installs.
5) The City will receive regular permit fees for excavation, etc. for all adjacent work.
6) WITN will be allowed to negotiate agreements with other facility owners like WE Energies to use WITN facilities.
7) City staff will be allowed sixty days to review their drawings & specifications and negotiate appropriate medications.
8) WITN equipment, etc. will not interfere with the City's existing equipment.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Director of Public Works/City Engineer and other appropriate City Officials are hereby authorized and directed to execute and deliver the aforesaid agreement to WITN on behalf of the City of West Allis.

BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer, with the approval of the City Attorney, be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the amended lease agreement, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and mainta...
