Resolution to confirm and adopt the request of the City Attorney's Office to assess a special charge to the property owner for the repair of the sidewalk located at 6006 West Orchard Street.
Body
WHEREAS, on May 23, 2016, a Public Works employee discovered that the City sidewalk at 6006 West Orchard Street in the City of West Allis had been damaged; and,
WHEREAS, on July 13, 2016, Public Works employees repaired the sidewalk at that location at the cost of $471.31; and,
WHEREAS, the matter was referred to the City Attorney's Office for collection, and the City Attorney's Office determined that pursuing the repair costs as a special charge was in the best interests of the City; and,
WHEREAS, pursuant to Wis. Stat. Sec. 66.0627(3)(b), the Common Council must hold a public hearing to determine whether the sidewalk repair will be funded in whole or in part by a special charge; and,
WHEREAS, the City Attorney's Office gave due notice of the hearing by having notice of the hearing published at least 20 days before the hearing date and mailing proper notice of the hearing at least 10 days before the hearing to each interested person whose address was known to it, and by giving due notice that all persons interested could appear before the Common Council and be heard concerning the special charge; and,
WHEREAS, the Common Council met pursuant to such notice, at the time and place therein named; and having considered all statements and communications concerning the proposed special charge, the Common Council has determined that the special charge of $471.31 shall be imposed in whole against the property located at 6006 West Orchard Street.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis:
1. The request of the City Attorney's Office for the imposition of a special charge in whole for the sidewalk repair at 6006 West Orchard Street is hereby approved and adopted.
