Ordinance to Amend Subsection 2.25(3)(b)1 of the West Allis Revised Municipal Code Relating to Farmers Market Events.

The Common Council of the City of West Allis do ordain as follows:
PART I. Subsection 2.25(3)(b)1 of the Revised Municipal Code of the City of West Allis is hereby amended to read as follows:
2.25 Board of Health.

(3) Functions and Duties.
* * *
(b) The Board of Health shall also have the following powers and duties relative to the operation of the Farmers Market.
1. Establishment of all rules and regulations for its proper operation and use except that liability insurance for certain permits shall be governed by Section 5.2.13 of the parks policy established pursuant to Section 11.13(3) of the Revised Municipal Code, alcohol use shall be governed by Sections 5.2.3, 5.2.14, and 5.2.20 of the parks policy established pursuant to Section 11.13(3) of the Revised Municipal Code, and the contiguity requirement in Section 9.02(5)(b)2 of the RMC shall not apply to Class "B" establishments temporarily extending their premises onto the Farmers Market for special events.

PART II. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
PART III. This ordinance shall take effect and be in force from and after its passage and publication.
