Title

Ordinance to Amend Subsection 9.02(13)(a)2 of the West Allis Revised Municipal Code Relating to Sanitation Inspections for Class B and Class C Licenses.

Body

The Common Council of the City of West Allis do ordain as follows:

PART I.  Subsection 9.02(13)(a)2 of the Revised Municipal Code is hereby amended to read as follows:

9.02 Alcoholic Beverages.

(13)  Restrictions.

(a) In General.  The following restrictions shall apply to the granting of licenses:

2.   No retail Class B fermented malt beverage or intoxicating liquor license or Class C license shall be issued unless the premise is conformed to the sanitary, safety and health requirements of the State Building Code, and the licensee satisfactorily demonstrates compliance with the rules promulgated by the Department of Agriculture, Trade, and Consumer Protection in regard to restaurant sanitation during a sanitation inspection from the West Allis Health Department as set forth in Wis. Stat. Sec. 125.68(5) and West Allis Revised Municipal Code Section 7.04(6).

PART II.  All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby amended.

PART III.  This ordinance shall take effect and be in force from and after its passage and publication.
