Resolution to Approve a Temporary Fourth Extension and Amendment to Recycling/Processing Agreement by and between Allied Resource Recovery, Inc. and the City of West Allis.

Body
WHEREAS, the City of West Allis ("City") entered into the original Agreement dated October 1, 1994, with West Allis Salvage Co., Inc. (now Allied Resource Recovery) for the recycling/processing of recyclable materials collected by the City (the "Contract"); and,

WHEREAS, the Contract was extended and amended on March 27, 2001, with a new expiration date of September 30, 2004; and,

WHEREAS, on February 27, 2004, the Common Council approved extending the terms and conditions of the existing Contract through December 31, 2006; and,

WHEREAS, on June 9, 2008, the City of West Allis Common Council approved the extension and amendment of the Contract which included a new expiration date of December 31, 2016; and,

WHEREAS, the City is now investigating converting to single stream recycling where all recyclables would be collected from a cart compared to the current duel stream; and,

WHEREAS, the City is now negotiating with the City of Milwaukee for processing services and will need more time to convert to the new system; and,

WHEREAS, Allied Resource Recovery has agreed to a temporary extension of their current terms and conditions of the Contract to April 1, 2017.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:

1. That the Fourth Extension and Amendment to Recycling/Processing Agreement, which is attached hereto and made a part hereof, be and is hereby approved.

2. That the Director of Public Works/City Engineer and other appropriate City officials be and are hereby authorized and directed to execute and deliver the amended Contract on behalf of the City.
