A Resolution to Amend the City’s Policies & Procedures Manual No. 2814 Relating to the 10-Year Sidewalk Repair Program.
Body
WHEREAS, Policy No. 2814 sets forth rules and procedures for the 10-year sidewalk repair program; and,
WHEREAS, current policy requires the Engineering Department to review and repair sidewalks when certain criteria for defects are present; and
WHEREAS, the policy sets forth duties that are not required by statute or law and may not be appropriate in every circumstance; and
WHEREAS, the change in policy to make the duties discretionary will not have an adverse impact upon the City and will lessen the City’s liability for claims concerning sidewalk repair; and
WHEREAS, removing the mandatory requirements of this policy will allow the training and experience and knowledge of the Engineering Department and Department of Public Works to better resolve sidewalk complaints within the budgetary constraints that the City faces.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the amendments to Policy No. 2814 as attached hereto are hereby approved and adopted.
