Resolution to Impose a Moratorium on Issuance of Right of Way permits for Installation of New Other Than Standard Utility and Light Poles as defined in Section 11.11 of the Revised Municipal Code.

WHEREAS, the City of West Allis currently issues Right of Way permits for the Installation of Pole locations throughout the City of West Allis in accordance with Section 11.11 of the Revised Municipal Code; and,

 

WHEREAS, the Engineering Division of the Department of Public Works is preparing a proposed ordinance to amend the terms, conditions and restrictions under which such uses are to be permitted; and,

 

WHEREAS, the City has no intention of permanently denying occupancy of Right of Way with New Poles, but seeks only a brief and temporary interval in permit issuance to consider possible impacts that undermine the health, safety and welfare of West Allis residents; and,

 

WHEREAS, it is in the City’s interest to put all future applications for new Poles on hold until the proposed ordinance is introduced and acted upon.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that a moratorium be imposed on the granting and issuing of all aforementioned permits for a period of ninety days.

 

BE IT FURTHER RESOLVED that the moratorium may be extended by the Common Council for up to an additional one month if review of the proposed ordinance is still pending.
