Title

Resolution authorizing contingency funds for the Reservoir Park Improvements Project, in an amount not to exceed $25,000.

 

Body

WHEREAS, the Common Council of the City of West Allis (the “City”), has authorized various contracts for the Reservoir Park Improvements Project (R-2016-0095 and R-2016-0214 for a professional services contract with Ayres Associates; R-2016-0188 for the purchase of playground equipment with Gerber Leisure Products; and, R-2016-0197 for the construction of a new playground area with Bluemel’s Maintenance Services, Inc.); and,

 

WHEREAS, the above-mentioned contracts total $503,793, appropriated from Parks and Playground Improvement Program funds; and,

 

WHEREAS, a contingency fund, not to exceed $25,000, shall be established for the Reservoir Park Improvements Project for unforeseen expenses, change orders that may be necessary with the consultant or contractor, and/or additional expenses necessary to complete the project; and,

 

WHEREAS, the Director of the Department of Development or the Director of Public Works/City Engineer shall be authorized to enter into such necessary contracts and/or contract amendments with the authorized $25,000 in contingency funds.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:

 

1.                     That a contingency fund for the Reservoir Park Improvements Project shall be established, in an amount not to exceed $25,000.

 

2.                     That the sum of $25,000 be and is hereby appropriated from Parks and Playground Improvement Program funds.

 

3.                     That the Director of the Department of Development or the Director of Public Works/City Engineer, or their designees, shall be authorized to enter into such necessary contracts and/or contract amendments with the authorized $25,000 in contingency funds.

 

3.                     That the City Attorney be and is hereby authorized to make such substantive and non-substantive changes, modifications, additions and deletions to and from the various provisions of Contracts, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
