Title
Resolution adopting three easement agreements (for storm water facilities, utilities and access) by and between CCM -ROOSEVELT SCHOOL, LLC and CITY OF WEST ALLIS, a Wisconsin municipal corporation.

Body
WHEREAS, CCM -ROOSEVELT SCHOOL, LLC (Cardinal Capital Management) has purchased a portion of the property at 932 S. 60 St. and subdivided the property via Certified Survey Map into two lots (via Common Council Resolution, R-2016-0201), for the purposes of the construction of a new medical facility (fronting S. 60 St.).

WHEREAS, the property owner, CCM -ROOSEVELT SCHOOL, LLC ("Grantor") will grant and convey to the CITY OF WEST ALLIS, a Wisconsin municipal corporation ("Grantee"), easements as described and shown in the attached easement agreement exhibits hereof toward the operation and maintenance of storm water facilities, utilities and access to the site.

WHEREAS, the Grantor is willing to grant said easements for storm water facilities, utilities and access therefore on the terms and conditions hereof.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Director of Public Works/City Engineer be and are hereby authorized and directed to execute the storm water facilities, utilities and access easements, copies of which are attached, on behalf of the City as adopted and approved.

BE IT FURTHER RESOLVED, that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the contract, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary to complete the transactions contemplated therein.
