An Ordinance to Create Subsections 9.01(1)(a) and (b) of the West Allis Revised Municipal Code Relating to the Number of Class A Licenses.

The Common Council of the City of West Allis do ordain as follows:
PART I. Section 9.01(1)(a) and (b) of Revised Municipal Code of the City of West Allis is hereby created to read:
9.01 Number of Licenses.
(1) Class A Licenses.
(a) The restrictions set forth on the number of Class A licenses in subsection (b) notwithstanding, there shall be no Class A quota for full service grocery stores. As used herein, a “full service grocery store” shall mean a retail establishment that primarily sells food, including both perishable and non-perishable items. A full service grocery store also includes a supermarket that also sells non-food products such as clothing, and household items. A full service grocery store does not include a retail establishment that also sells gasoline, is a convenience store or a pharmacy.
(b) The number of Class A licenses, whether for intoxicating liquor, fermented malt beverages, or both, to be granted or issued by the Common Council shall be limited to twenty (20).

PART II. All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
PART III. This ordinance shall take effect and be in force from and after its passage and publication.
