Title

Resolution authorizing and directing the Director of Public/City Engineer to enter into a revised lease agreement for telecommunication facilities at 11515 West Rogers Street with AT&T.

 

Body

WHEREAS, AT&T has requested to make certain modifications to the current least agreement for use of the Water Department’s elevated tower at 11515 West Rogers Street; and,

 

WHEREAS, AT&T believes that these lease modifications will allow AT&T to meet their current business requirements and enhance this site’s value to the network; and,

 

WHERAS, AT&T, in partnership with Md7, desires to install, maintain, modify, upgrade and operate telecommunication equipment on the water tower, including but not limited to antennas, remote radio units, equipment/battery cabinets and associated cabling; and,

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Director of Public Works/City Engineer and other appropriate City Officials are hereby authorized and directed to execute and deliver the aforesaid amendment to the lease/agreement/license on behalf of the City of West Allis.

 

BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer, with the approval of the City Attorney, be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the amended lease agreement, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof and to protect the interests of the City, including but not limited to, any and all changes necessary to preserve the intent of the Common Council of the City of West Allis.
