Title

Resolution authorizing and directing the Director of Public/City Engineer to enter into a revised “small cell” master license agreement with Verizon Wireless Personal Communications.

 

Body

WHEREAS, Verizon Wireless Personal Communications (Verizon) desires to install, maintain and operate “small cell” communications equipment, including but not limited to antennas, remote radio units, equipment/battery cabinets and associated cabling in and/or upon certain light poles owned by the City of West Allis; and,

 

WHEREAS, the City and Verizon desire to enter into this Master License Agreement to define the general terms and conditions which would govern the use of specific sites in the City for Verizon’s “small cell” communication equipment; and,

 

WHEREAS, the City and Verizon acknowledge that they will enter into a License Supplement with respect to any specific location(s) when those location(s) are determined and the License Supplement is approved by the Common Council of the City of West Allis.

 

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Director of Public Works/City Engineer and other appropriate City Officials are hereby authorized and directed to execute and deliver the aforesaid Master License Agreement on behalf of the City of West Allis.

 

BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer, with the approval of the City Attorney, be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Master License Agreement, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof and to protect the interests of the City, including but not limited to, any and all changes necessary to preserve the intent of the Common Council of the City of West Allis.
