Title

Ordinance to Amend Subsection 7.035(11)(b) of the City of West Allis Revised Municipal Code Relating to Hearing on Variance Permit.

Body

The Common Council of the City of West Allis do ordain as follows:

PART I.  Subsection 7.035(11)(b) of the Revised Municipal Code is hereby amended to read as follows:

7.035  Noise Control Regulations.

(11)  Variance.

* * *

(b)  Hearing on Variance Permit.  Within sixty (60) days of receiving the application for a variance permit, the License and Health Committee shall hold a public hearing.  The City Clerk shall serve the variance applicant with notice of such hearing by mail or personal service at least ten (10) days before such hearing.  Additionally, the City Clerk shall mail notice of the hearing to property owners within two hundred (200) feet of the affected property at least ten (10) days before such hearing.

PART II.  All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.

PART III.  This ordinance shall take effect and be in force from and after its passage and publication.
