Resolution relative to determination of a Special Use Permit for the Dog House Tavern to establish an extension of premise to utilize an existing outdoor patio located at 1641 S. 68 St.

WHEREAS, Janice S. Fazen, d/b/a The Dog House Tavern, an existing tavern, duly filed with the City Clerk an application for a special use permit, pursuant to Sec. 12.41(2) and Sec. 12.16 of the Revised Municipal Code, for an outdoor extension of premise at their existing location, at 1641 S. 68 St. for the existing tavern; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on October 7, 2014 at 7:00 p.m., in the Common Council Chamber to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The property is owned by Janice S. Fazen, d/b/a The Dog House who resides at 1709 S. 68 St. West Allis, WI 53214.

2. The property consists of an existing tavern with an existing outdoor deck. The existing outdoor deck is located within a fenced rear yard area of the property. The applicant requests an extension of licensed premise to utilize the existing outdoor deck (approximately a 600-sf area) within the rear yard of the tavern. The deck area is currently used for outdoor smoking. The proposal is to further utilize the existing outdoor patio area as an outdoor extension of premise at 1641 S. 68 St., West Allis, Wisconsin, more particularly described as follows:

All the land of the owner being located in the Northwest 1/4 of Section 3, Township 6 North, Range 21 East, in the City of West Allis, Milwaukee County, State of Wisconsin, described as follows:

Lot 24 in Block 2 of the Gross West Allis Addition subdivision.

Tax Key No. 453-0582-000

Said land being located at 1641 S. 68 St.
