Resolution relative to determination of Special Use Permit for proposed auto repair facility, J&S Auto Repair, to be located at 662 S. 93 St.

WHEREAS, James G. Diehl, lessee, d/b/a J&S Accel, Inc. duly filed with City Administrative Officer-Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.16 and Sec. 12.42(2) of the Revised Municipal Code to establish an auto repair/service facility within the existing building located at 662 S. 93 St.; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on May 6, 2014, at 7:00 p.m. in the Common Council Chambers to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant James G. Diehl, lessee, d/b/a J&S Accel, Inc., has offices at 2025 S. 54 St., West Allis, WI 53219.

2. James G. Diehl, lessee, d/b/a J&S Accel, Inc., will lease said premises located at 662 S. 93 St., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:

All the land of the owner being located in the Northeast ΒΌ of Section 32, Township 7 North, Range 21 East, City of West Allis, Milwaukee County, State of Wisconsin, described as follows:

Lot 17 and North 15.00 feet of Lot 16 in Block 6, and Lot 15 and South 20.00 feet of Lot 16 in Block 6 of the Conrad Hill subdivision.

TAX KEY NOS: 416-0048-001 and 416-0046-001

Said Property being located at 662 S. 93 St.

3. The aforesaid area is zoned C-3 Community Commercial District under the Zoning Ordinance which permits auto repair as a special use within the existing building, pursuant to Sec. 12.16 and Sec. 12.42(2) of the Revised Municipal Code.
