Resolution approving a Purchase & Sale Agreement for the McKinley Park property by and between the City of West Allis and the School District of West Allis-West Milwaukee, et al.

Body
WHEREAS, the Common Council, by Resolution No. R-2013-0285 adopted December 17, 2013, approved the Joint Agreement between the School District of West Allis-West Milwaukee et al, and the City of West Allis relative to cooperating on a number of projects of mutual interest; and,

WHEREAS, the School District of West Allis-West Milwaukee, et al has requested to assume ownership and maintenance of the McKinley Park property located along the east side of S. 72nd Street between W. Walker and W. Washington Streets, in the City of West Allis, Milwaukee County, Wisconsin, consisting of approximately 5.122 acres of land (the "Property"); and,

WHEREAS, the City desires to cooperate with the School District to the greatest extent possible and accepts the terms & conditions of the attached Purchase and Sale Agreement.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Purchase & Sale Agreement for the Property, a copy of which is attached hereto and made apart hereof, by and between the City of West Allis and the School District of West Allis-West Milwaukee, et al be and is hereby approve.

BE IT FURTHER RESOLVED that the Director of Development is hereby authorized and directed on behalf of the City to execute and deliver the aforesaid Agreement and all documents additionally necessary to complete the transaction.

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and ma...
