Resolution to approve the Memorandum of Understanding by and between the County of Milwaukee and the City of West Allis relative to stormwater.

Body
WHEREAS, it is proposed that the Memorandum of Understanding for stormwater will provide significant benefits to the City's overall stormwater management system; and,

WHEREAS, West Allis has many storm sewers that discharge onto Milwaukee County property, benefiting the City significantly; and,

WHEREAS, since Milwaukee County is benefiting the City, it has been recommended that staff prepare the necessary modifications to the Memorandum of Understanding for Milwaukee County; and,

WHEREAS, the City has a number of stormwater sewers on land now owned by Milwaukee County where there are no current easements providing for the maintenance and repairs of these City stormwater sewers; and,

WHEREAS, staff is directed to also seek from Milwaukee County all necessary stormwater easements needed by West Allis and request Milwaukee County to provide these easements at no cost or fees.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Memorandum of Understanding, a copy of which is attached hereto and made a part hereof, be and is hereby approved.

BE IT FURTHER RESOLVED that the Director of Public Works/City Engineer is hereby authorized to execute and deliver the aforesaid Memorandum of Understanding on behalf of the City.

BE IT FURTHER RESOLVED that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the contract, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, and to prepare and deliver such other and further documents as may be reasonably necessary...
