Ordinance to repeal and recreate Sec. 2.08 of the West Allis Municipal Code to allow for split shifts of election inspectors and alternate election officials

Whereas, Wis. Stat. § 7.30(1) allows the common council to provide by ordinance for the selection of alternate officials or the selection of 2 or more sets of officials to work at different times on election day; and
Whereas, Wis. Stat. § 7.30(1) allows the common council to empower the city clerk to establish different working hours for different officials assigned to the same polling place; and
Whereas, it is in the city interest to provide flexibility to the city clerk’s office to ensure appropriately staffed polling places;
Now, therefore, the Common Council of the City of West Allis do ordain as follows:
Part 1. Code Revision. Section 2.08 of the Municipal Code is hereby repealed and recreated to read as follows:
2.08. Elections and Election Officials
(1) The city clerk may select alternate officials in a number sufficient to maintain adequate staffing of polling places on election day.
(2) The city clerk may select 2 or more sets of election officials to work at different times on election day and may establish different working hours for different officials assigned to the same polling place.
Part 2. Inconsistent Law Repealed. All ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed.
Part 3. Severability. The provisions of this ordinance are severable. If any provision of this ordinance is invalid, or if the application of this ordinance to any person or circumstance is invalid, such invalidity shall not affect other provisions or applications which can be given effect without the invalid provision or application.
Part 4. Effective Date. This ordinance shall take effect and be in force from and after its passage and publication.
