Resolution relative to determination of Special Use Permit for Happy Tails Pet Training, a proposed dog training business, to be located at 1412 S. 72 St.

WHEREAS, Jennifer Nowak, d/b/a Happy Tails Pet Training LLC, duly filed with the City Clerk an application for a Special Use Permit, Pursuant to Sec. 12.40 and Sec. 12.16 of the Revised Municipal Code, to establish a dog training business; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on April 4, 2016 at 7:00 p.m., in the Common Council Chamber to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, Jennifer Nowak d/b/a Happy Tails Pet Training, LLC, has offices at 4823 W. Tesch Ave., Milwaukee, WI 53220.

2. The applicant plans to lease a portion of the mixed use building located at 1410-12 S. 72 St. and 7139-49 W. Greenfield Ave., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:

All that land of the owner being located in the Northwest 1/4 of Section 3, Township 6 North, Range 21 East, City of West Allis, Milwaukee County, State of Wisconsin describes as follows:

Lots 7 and 8 in Block 5 of Central Improvement Co. Subdivision No. 1.

Tax Key No. 453-0063-000

Said land being located at 1410-12 S. 72 St. & 7139-49 W. Greenfield Ave.

3. The applicant is proposing to establish a dog training facility, Happy Trails Pet Training, which will occupy approximately 810 sq. ft. of the near 13,000 square foot mixed-use building which includes ten (10) 2nd floor residential units.

4. The aforesaid premises is zoned C-1 Central Business District under the Zoning Ordinance of the City of West Allis, which permits dog training facilities as a Special Use, pursuant to Sec. 12.40 and Sec. 12.16 of the Revised Municipal Code.
