An Ordinance to Amend Subsection 9.02(5)(b)5 of the City of West Allis Revised Municipal Code Relating to Alcoholic Beverages Temporary Extension of Class B Tavern Licensed Premises for Special Events.

The Common Council of the City of West Allis do ordain as follows:
 
PART I.  Subsection 9.02(5)(b)5 of the Revised Municipal Code of the City of West Allis is hereby amended to read:
 
9.02  ALCOHOLIC BEVERAGES.

(5)  Extension of Premises.

(b)  Temporary Extension of Class "B" Tavern Licensed Premises for Special Events.

5.  Council Action.  The Common Council may, in its discretion, grant or deny the application.  If the application is denied, the City Clerk shall, in writing, notify the applicant of the decision and the Council's reasons for denial.  In deciding whether to grant a license, the Common Council may consider, among other factors, the appropriateness of the location for which a temporary extension of licensed premises is sought, whether such location will create an adverse impact on other property in the neighborhood, and any other factors which reasonably relate to the public health, safety and welfare.  More than three temporary extension permits per licensing year shall be presumed to be unreasonable.

PART II.  All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby amended.
 
PART III.  This ordinance shall take effect and be in force from and after its passage and publication.
