Resolution relative to determination of Special Use Application to establish an auto repair facility within the building located at 12323 W. Fairview Ave. (Tax Key No. 413-9996-006).
Body
WHEREAS, Doris Pelc, d/b/a August Schmidt Co., duly filed with the City Administrative Officer-Clerk/Treasurer an application for a special use permit, pursuant to Sec. 12.45(2) and Sec. 12.16 of the Revised Municipal Code, to establish a commercial vehicle repair facility within the existing building located at 12323 W. Fairview Ave.; and,
WHEREAS, after due notice, a public hearing was held by the Common Council on May 17, 2005, at 7:00 p.m., in the Common Council Chamber to consider the application; and,
WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:
1. The applicant, Doris Pelc, d/b/a August Schmidt Co., has offices at 11020 W. Mitchell St., West Allis, WI 53214.
2. The applicant has a valid offer to lease a portion of the property at 12323 W. Fairview Ave., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:
All the land of the owner being located in the Northwest ¼ of Section 31, Township 7 North, Range 21 East, City of West Allis, Milwaukee County, Wisconsin, described as follows:
Commencing at the Northwest corner of the said Northwest ¼ ; thence Easterly, 200.00 feet, along north line of said Northwest ¼ ; thence Southerly, 23.00 feet to the south right-of-way line of West Fairview Avenue and Point of Beginning; thence, continue, Southerly, 245.92 feet; thence Southwesterly, 121.70 feet; thence Northwesterly, 255.35 feet, to the said south right-of-way line; thence Easterly, 170.29 feet, along said south line to the Point of Beginning.
