Title

Resolution relative to determination of Special Use Permit for proposed AT&T (formerly SBC) easement expansion for a cross-box, fiber conversion cabinet, and power transfer switch box (telephone equipment) to be located within a city parking lot at 1351-53 S. 64 St. (Tax Key No. 439-0147-001).

Body

WHEREAS, Edward Polito, d/b/a MI-Tech Services, duly filed with the City Administrative Officer, Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.16 and 12.36(3) of the Revised Municipal Code to construct telephone equipment cabinet boxes within a city parking lot located at 1351-53 S. 64 St.; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on April 18, 2006, at 7:00 p.m. in the Common Council Chambers to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, Edward Polito, d/b/a MI-Tech Services, has principal offices at 16510 W. Rogers Drive, New Berlin, WI 53151.

2. AT&T (whom the applicant is representing) currently has an easement agreement within this parking lot and wishes to expand the above ground telephone equipment easement area at the site located at 1351-53 S. 64 St., West Allis, Milwaukee County, Wisconsin 53214, more particularly described as follows:

Utility easement being located in the Southeast ΒΌ of Section 34, Township 7 North, Range 21 East, in the City of West Allis, Milwaukee County, State of Wisconsin, described as follows:

Part of the South 15.00 feet of Lot 12, being part of the Block 11 in Second Continuation of Soldiers Home Heights Company's Subdivision.

Tax Key No. 439-0147-001

Said land being located at 1351-53 S. 64 St.

3. AT&T currently has a 94-foot long, 10-foot wide easement agreement with the City along the north edge of the existing city parking lot behind Crawdaddy's Restaurant. The existing...
