Resolution Terminating All Provisions of Collective Bargaining Agreements.

 

Body

 

WHEREAS, the Wisconsin Legislature in 2011 Acts 10 and 32, among other things, ended the ability of certain public sector employees to collectively bargain over most subjects; and,

 

WHEREAS, the collective bargaining agreements for AFSCME - Local 80 Public Works and Clerical Units, Engineering Technician and Aides' Association, and West Allis Federation of Nurses Local 5038, expire on December 31, 2011; and,

 

WHEREAS, the combination of the Legislature's action and the expiration of said collective bargaining agreements requires that the City take action to ensure the smooth transition from a workforce governed by collective bargaining agreements to one governed by ordinances, policies and rules.

 

NOW, THEREFORE, BE IT RESOLVED, that effective at 11:59 pm on December 31, 2011, the collective bargaining agreements with the AFSCME - Local 80 Public Works and Clerical Units, Engineering Technician and Aides' Association, and West Allis Federation of Nurses Local 5038, are terminated.  All provisions of said contracts and all past practices, memoranda of understanding, agreements, etc., that are prohibited subjects of bargaining under 2011 Acts 10 and 32 are, as of the effective date and time, null and void.

 

BE IT FURTHER RESOLVED, that the City will, on its own volition, continue to pay wages, provide benefits, and otherwise maintain the same working conditions, with the exception of Ordinances, Policies and Procedures, and/or Rules and Regulations that have already been adopted or modified by the City since implementation of 2011 Acts 10 and 32, until such time as the City, in its sole discretion, decides to make a change or changes, with or without notice.
