An Ordinance to Amend Subsection 9.28(5) of the West Allis Revised Municipal Code Relating to Adult Oriented Establishments

The Common Council of the City of West Allis do ordain as follows:
 
PART I.      Subsection 9.28(5) of the Revised Municipal Code are hereby amended to read:
 
9.28      ADULT ORIENTED ESTABLISHMENTS.

(5)       PERMIT REQUIRED.  In addition to the license requirements previously set forth for owners and operators of adult-oriented establishments, no person shall be an employee or entertainer in an adult-oriented establishment without first obtaining a valid permit issued by the City Clerk under authority of the Common Council.  During the pendency of an application for an annual permit, the City Clerk shall issue the applicant a temporary permit which shall be valid only until such time as the application for an annual permit is approved or denied by the Common Council pursuant to the procedures set forth herein.  Under no circumstances shall any temporary permit be valid for more than ninety days.  Temporary permits shall be non-transferable.

PART II.      All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
 
PART III.      This ordinance shall take effect and be in force from and after its passage and publication.
