Resolution authorizing a Lease Agreement by and between the City of West Allis and the School District of West Allis-West Milwaukee, et al for two soccer fields initially located at Reservoir Park and ultimately at the Open Space behind the West Allis Police Station.

Body
WHEREAS, the City is the owner of the property known as Reservoir Park, see attached Exhibit “A” Reservoir Park Map and the City is also the owner of the property known as the Open Space behind the West Allis Police Station located at 11301 W. Lincoln; and,

WHEREAS, the School District of West Allis-West Milwaukee, et al is in need of two soccer fields for school and recreational uses; and,

WHEREAS, the Common Council approved Resolution R-2013-0285 which provided for a Joint Agreement between the School District of West Allis-West Milwaukee, et al, and the City of West Allis relative to several projects, including Soccer Fields, McKinley Park, dark fiber, Jefferson school, Madison easement, Roosevelt easement, Franklin Fieldhouse tennis court conversion to parking lot, former Parkway school, former Heritage School and Nathan Hale track extension.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the Director of Development is hereby authorized and directed on behalf of the City to enter into a lease agreement generally consistent with the attached SCHOOL DISTRICT SOCCER FIELDS LEASE.

BE IT FURTHER RESOLVED that the Director of Development is hereby authorized to negotiate the Terms and Conditions of said Lease Agreement at his discretion, subject to the approval of the City Attorney.

BE IT FURTHER RESOLVED that the City Attorney be, and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Agreement, including any and all attachments, exhibits, addendums and amendments, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and o...
