Resolution authorizing the City Engineer and City Attorney to declare WB Corporation in default on 2002 Project No. 14, Fire Station No. 1 and directing them to take all appropriate action necessary to complete the project.
Body
WHEREAS, WB Corporation continues to have a number of items to replace and/or repair on Fire Station No. 1; and,
WHEREAS, the City Engineer has offered partial payment and has asked WB Corporation to make arrangements for completing the project along with a schedule which shows when all the outstanding work will be completed; and,
WHEREAS, WB Corporation has thus far refused to complete the project until paid in full for all work, done and not done; and,
WHEREAS, the City Engineer has discussed his concerns and asked for advice on how to complete the Fire Station No. 1 project with the City Attorney; and,
NOW, THEREFORE, BE IT RESOLVED By the Common Council of the City of West Allis that the City Engineer and City Attorney be and is hereby authorized and at their discretion, directed to declare WB Corporation in default of the contract and take all appropriate action necessary to complete the project.
