An Ordinance to Create Section 6.02(23) of the West Allis Revised Municipal Code Relating to Trespassing on Private Property.

The Common Council of the City of West Allis do ordain as follows:
 
PART I.  Section 6.02(23) of the Revised Municipal Code of the City of West Allis is hereby created to read:
 
6.02      PUBLIC OFFENSES.

(23)      Trespassing on Private Property.  No person shall enter or remain upon the lands, buildings, or premises of another or any part, portion, or area thereof if:  
 
(1)      The owner, owner's agent or representative, lessee, custodian, or other person in possession thereof forbids or warns him/her not to enter or remain, whether orally or in writing; or
 
(2)      A reasonably visible sign posted on such lands, building, premises, or any part or portion thereof, forbids or warns him/her not to enter or remain.
 
(a)      Signs shall be posted at all common entrances and shall be at least 8 ½ by 11 inches in size, with letters at least 1 inch in height.
 
(3)      Exceptions.  This prohibition does not apply to law enforcement officers, firefighters, or rescue personnel acting under the scope of their official duties; or any person who, in the scope of his or her employment, has a lawful right to be on the property.
 
(4)      Penalties.  Any person, firm, or corporation violating this section shall, upon conviction, forfeit not less than three hundred dollars ($300) nor more than one thousand dollars ($1000), together with the costs of prosecution and, in default of payment, shall be imprisoned in the House of Correction until such forfeiture and costs are paid, but not more than the number of days set forth in Section 800.095(4), Wis. Stat.
 
PART II.  All ordinances or parts of ordinances contravening the provisions of this ordinance are hereby repealed.
 
PART III.  This ordinance shall take effect and be in force from and after its passage and publication.
