Title

Resolution authorizing and directing the City Engineer to sign an Encroachment Agreement with the Union Pacific Railroad Company for use of their right-of-way for a sanitary sewer.

Body

WHEREAS, the City currently has a 10 inch sanitary sewer inside the Union Pacific Railroad Company right-of-way at 95^th Street; and,

WHEREAS, the City needs to upsize this sanitary sewer to 12 inches.

NOW, THEREFORE, BE IT RESOLVED By the Common Council of the City of West Allis that the City Engineer, along with other appropriate City Officials, be and is hereby authorized and directed to sign the Encroachment Agreement on behalf of the City of West Allis. 

NOW, THEREFORE, FUTHER BE IT RESOLVED that the City Attorney be and is hereby authorized to make such substantive changes, modifications, additions and deletions to and from the various provisions of the Encroachment Agreement, as may be necessary and proper to correct inconsistencies, eliminate ambiguity and otherwise clarify and supplement said provisions to preserve and maintain the general intent thereof, including but not limited to, any and all changes necessary to preserve the interests of the City of West Allis.
