A Resolution to Amend the City’s Policies & Procedures Manual No. 2612 Relating to Snow Plow Damage Complaints.

WHEREAS, Policy No. 2612 sets forth rules and procedures for snow plow damage complaints; and,
WHEREAS, current policy requires the City to issue a work order for repairing damages when it is determined that property damage was caused by City snow plows; and
WHEREAS, the policy sets forth duties that are not required by statute or law and may not be appropriate in every circumstance; and
WHEREAS, the change in policy to make the duties discretionary will not have an adverse impact upon the City and will lessen the City’s liability for claims concerning snow plow damage; and
WHEREAS, removing the mandatory requirements of this policy will allow the training and experience and knowledge of the Engineering Department and Department of Public Works to better resolve snow plow damage complaints within the budgetary constraints that the City faces.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis that the amendments to Policy No. 2612 as attached hereto are hereby approved and adopted.
