Resolution Approving Acquisition of Certain Lands and Interests for Sanitary Sewer Improvements for parcels of lands South of West Greenfield Avenue between South 82nd Street to South 84th Street.

WHEREAS, the Engineering Department of the City of West Allis has determined and approved bidding for a sanitary sewer, thirty (30) feet below grade, to be installed two hundred seventy-seven (277) feet south of West Greenfield Avenue between South 82nd and South 84th Streets described in Engineering Drawing File Nos. Y-1137, Y-1138, Y-1139, Y-1140 and Y-1141, dated October 1, 2003, which are attached hereto as Exhibits "A", "B", "C", "D" and "E" and made a part hereof, and South 84th Street in Resolution No. R-2003-0312, adopted October 21, 2003, by the Common Council of the City of West Allis; and,
WHEREAS, there will be no displacement of persons as a result of the project.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis as follows:
1. That the City Attorney be and is hereby authorized and directed to acquire by just compensation as stated on the attached Exhibit "F" for the lands and interests set forth in Exhibits "A", "B", "C", "D" and "E" from the record owners thereof and from any and all other persons or entities which may have an interest in said lands.
2. That it hereby declares its intent to proceed with acquisition of the aforesaid lands and interests under the eminent domain procedures of Chapter 32 of the Wisconsin Statutes.
3. That it recognizes the City's responsibilities to make such payments for expenses incidental to the dedication of lands and interests hereunder, as may be required pursuant to Section 32.195 of the Wisconsin Statutes, and, therefore, directs compliance therewith in all respect.
