Resolution relative to determination of Special Use Application to establish a restaurant and banquet facility within the former Mykonos Restaurant located at 8201 W. Greenfield Ave. (Tax Key No. 451-0644-005)

WHEREAS, Jeff Kerwen, Bill Kostopoulos and Petros Visvardis, d/b/a Atlas Restaurant, duly filed with the City Administrative Officer-Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.42(2) and Sec. 12.16 of the Revised Municipal Code of the City of West Allis, to permit a restaurant and banquet hall at 8201 W. Greenfield Ave.; and,
WHEREAS, after due notice, a public hearing was held by the Common Council on April 19, 2005, at 7:00 p.m., and in the Common Council Chambers to consider the application; and,
WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:
1. The applicant, Jeff Kerwen, has an office at S 106 W20183 North Shore, Muskego, WI 53150. The property is owned by Tom Miller who has an office at 7246 W. Greenfield Ave., West Allis, Wisconsin 53214-3214
2. The applicant possesses a valid offer to lease the property at 8201 W. Greenfield Ave., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:
All the land of the owner being located in the Northwest ¼ of the Northeast ¼ of Section 4, Township 6 North, Range 21 East, City of West Allis, Milwaukee County, State of Wisconsin, more particularly described as follows:
Lot 3 of Certified Survey Map No. 6510.
Above described land is subject to the existing access easement.
Tax Key No. 451-0644-005.
Said land being located at 8201 W. Greenfield Ave.
