Resolution in support of temporary relief from enforcement of certain ordinances affecting local businesses
Body
WHEREAS, the pandemic caused by the novel coronavirus (COVID-19) has negatively impacted local businesses, many of whom have experienced a significant loss of business or remained completely closed since March; and
WHEREAS, as businesses reopen, they will continue to experience significant challenges as they seek to provide goods and services to their customers in a safe manner; and
WHEREAS, it is in the City's best interest to temporarily relax or eliminate certain standards imposed by the municipal code in order to jump start our local economy's recovery; and
WHEREAS, the common council has the authority to amend the municipal code to provide relief to businesses, but due to publication and hearing requirements for zoning code matters, it is unable to effectuate those amendments in the immediate future to help businesses recover from the negative affects of COVID-19; and
WHEREAS, the executive branch of city government has the discretion to take enforcement action against individuals who violate city ordinances and state laws;
NOW, THEREFORE, BE IT RESOLVED, that the common council of the City of West Allis supports temporary relief to allow businesses to operate outdoors in a manner that is inconsistent with Sections 12.40(2)(o), 12.40(3)(b), 12.41(2)(y), 12.41(3)(a), 12.42(3)(a), and 12.43(2)(f) until November 1, 2020, under conditions established by enforcement authorities.
