Resolution relative to determination of Special Use Permit for a proposed adult daycare facility, Next Step in Day Services, to be located at 344-346 S. Curtis Rd., within the multi-tenant building at 334-46 S. Curtis Rd.

WHEREAS, Michael J. Tesch, d/b/a Next Step in Day Services, duly filed with the City Administrative Officer, Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.16 and Sec. 12.45(2)(a) of the Revised Municipal Code, to establish an adult daycare within a portion of the building located at 334-46 S. Curtis Rd.; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on February 7, 2012, at 7:00 p.m. in the Common Council Chambers to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, Michael J. Tesch, d/b/a Next Step in Day Services, has offices at 16208 W. Rogers Dr., New Berlin, Wisconsin 53151.

2. The applicant has a valid lease to occupy 344-46 S. Curtis Rd., located within the building at 334-46 S. Curtis Rd.,West Allis, Milwaukee County, Wisconsin, more particularly described as follows:

All the land of the owner being located in the Northwest ΒΌ of Section 31, Township 7 North, Range 21 East, City of West Allis, Milwaukee County, Wisconsin, described as follows:

Parcel 1 of the Certified Survey Map No. 6480.

Tax Key Number: 413-9999-037

3. The applicant is proposing to establish an adult daycare facility within approximately 3,800 sq. ft. of the 14,074 sq. ft. building.

4. The aforesaid premise is zoned M-1 Manufacturing District which permits adult daycares as a special use pursuant to Sec. 12.45(2)(a) and Sec. 12.16 of the Revised Municipal Code.

5. The subject property is part of an area along the east side of S. Curtis Rd., between W. Dixon St. and S. 116 St., which is zoned for manufacturing purposes....
