Title

Resolution Approving and Accepting a Permanent Storm Sewer Easement from Menard, Inc. for a storm sewer main located at approximately S. 109^th Street West 175 feet along the vacated West Arthur Avenue, including part of the Drainage Ditch.

Body

WHEREAS, the Common Council of the City of West Allis by Resolution No. R-2005-0298 adopted December 6, 2005, approved a Purchase and Sale Agreement Between Menard, Inc. and the City of West Allis for a portion of vacated West Arthur Avenue at South 109^th Street and part of the drainage ditch; and,

WHEREAS, the City of West Allis will need to acquire a Permanent Storm Sewer Easement, main together with the necessary appurtenances, along both North and South vacated West Arthur Avenue and 30 feet West on part of the adjacent drainage ditch in order to accomplish these improvements. 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Administrative Officer, Clerk/Treasurer be and are hereby authorized and directed on behalf of the City of West Allis to accept the Permanent Storm Sewer Easement, a copy of which is attached hereto, from Menard, Inc. for maintaining and operating the storm sewer.
