Resolution relative to amending the Section 125 Flexible Benefit Plan in compliance with the Security Regulations of the Health Insurance Portability and Accountability Act.

WHEREAS, the Security Regulations of the Health Insurance Portability and Accountability Act (HIPAA) require an amendment of the City of West Allis' Section 125 Flexible Benefit Plan (the "Plan") to address the Protection of Electronic Health Information; and,
WHEREAS, in order to comply with HIPAA, the Common Council of the City of West Allis deems that the Plan be amended in accordance with the attached Section 125 Flexible Benefit Plan Plan Document - Summary Material Modifications.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the City of West Allis that the Plan shall be amended effective April 20, 2006, as set forth in the attached document and that the City Administrative Officer, in his capacity as the Security Official for the City, is authorized and directed to execute said document amending the Plan on the City's behalf.
BE IT FURTHER RESOLVED that the Plan Administrator shall be instructed to take such actions that are deemed necessary and proper in order to implement the amended Plan, and to set up adequate accounting and administrative procedures to provide benefits under the Plan.
