Title

Resolution Relative to Vacation and Discontinuance of a Portion of an Alley North of West Walker Street Between South 56th Street and South 57th Street.

Body

WHEREAS, the public interest requires that a portion of an Alley North of West Walker Street between South 56th Street and South 57th Street, shown and legally described on the map of the City of West Allis Engineering Department dated January 15th, 2006, File No. Y-1148, which is attached hereto and incorporated herein by reference, be discontinued and vacated; and,

WHEREAS, this Resolution was introduced before the Common Council of the City of West Allis on February 7th, 2006; Notice of Pendency of the Resolution to vacate the aforesaid portion of an Alley was filed with the Register of Deeds of Milwaukee County on February 7th, 2006; and Notice of Hearing was published in the official City newspaper on February 23rd, 2006, March 2nd, 2006 and March 9th, 2006; and,

WHEREAS, no sufficient written objection to the vacation and discontinuance was filed with the City Administrative Officer, Clerk/Treasurer.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of West Allis, in accordance with the authority vested in the Common Council by Sec. 66.1003, Wisconsin Statutes, that a portion of an Alley North of West Walker Street between South 56th Street and South 57th Street, shown and legally described on the map of the City of West Allis Engineering Department dated January 15th, 2006, File No. Y-1148, which is attached hereto and incorporated herein by reference, be and the same is hereby vacated and discontinued, as required by the public interest.

BE IT FURTHER RESOLVED that certain public utility easements for gas, water, storm sewer, sanitary sewer and electric, upon, along, through and under the parcel of property shown and legally described on the map of the City of West Allis Engineering Department dated January 15th, 2006, File No. Y-1148, which is attached here...
