Title
Ordinance to amend Section 12.42 C-3 Community Commercial District to permit Indoor Auto Sales as a special use within the C-3 Community Commercial District.

Body
The Common Council of the City of West Allis do ordain as follows:

PART I. Subsection 12.42(2)(q) of the Revised Municipal Code of the City of West Allis is hereby created to read:

12.42 C-3 Regional Commercial District

(2) Special Uses.

***

(q) Indoor sales, rental or leasing of motor vehicles that are subject to motor vehicle registration and used for private personal use. (No outdoor sales or display of vehicles)

PART II. Subsection 12.43(2)(j) “Private passenger vehicle sales, rental and leasing, including repair, rebuilding and parts, and outdoor display conditioned upon the following:” (Subsections 1-8 under Subsection 12.43(2)(j) are not changing with this Ordinance) of the Revised Municipal Code of the City of West Allis is hereby amended to read:

12.43 C-4 Regional Commercial District.

(2) Special Uses.

(j) Outdoor sales, rental or leasing of motor vehicles that are subject to motor vehicle registration and used for private personal use subject to the following:

1. Minimum lot size: one (1) acre;
2. Twenty percent (20%) landscaping site coverage;
3. Off-street parking in accordance with Section 12.19;
4. All sales, repair and display shall be conducted on site;
5. All vehicle display and parking stalls to be identified on a site plan;
6. All repair/stored (not sale) vehicles may sit idle for no longer than 45 days;
7. All vehicles shall be licensed and registered with the Wisconsin Department of Transportation; and,
8. All service repair/overhead doors shall remain closed during vehicle repair.

PART III. All ordinances or parts of ordinance contravening the provisions of this ordinance are hereby repealed.

PART IV. This ordinance shall take effect and be in force from and after its passage and publication.
