Resolution relative to determination of Special Use Permit to demolish and rebuild Arby's Restaurant, an existing business located at 10743 W. National Ave. (Tax Key No. 519-9995-004)

Body
WHEREAS, Arby's Restaurant, through its owner, George Carisch, d/b/a Carisch Inc., duly filed with the City Administrative Officer-Clerk/Treasurer an application for a Special Use Permit, pursuant to Sec. 12.43(2) and Sec. 12.16 of the Revised Municipal Code, for the demolition and rebuild of a restaurant with an outdoor dining area and drive thru; and,

WHEREAS, after due notice, a public hearing was held by the Common Council on October 17, 2006, at 7:00 p.m. in the Common Council Chambers to consider the application; and,

WHEREAS, the Common Council, having carefully considered the evidence presented at the public hearing and the following pertinent facts noted:

1. The applicant, George Carisch, d/b/a Carisch, Inc., has offices at 681 E. Lake St., Suite 262, Wayzata, MN 55391.

2. The applicant, Carisch, Inc., owns the property at 10743 W. National Ave., West Allis, Milwaukee County, Wisconsin, more particularly described as follows:

All the land of the owner being located in the Southwest ΒΌ of Section 8, Township 6 North, Range 21 East, in the City of West Allis, Milwaukee County, State of Wisconsin, described as follows:

Lot 1 of the Certified Survey Map No. 728.

Said land being located at 10743 W. National Ave.

Tax Key Number: 519-9995-004.

3. The applicant is requesting to demolish the existing restaurant and build a new 3,300 sq. ft. restaurant with an outdoor dining area and drive-thru.

4. The aforesaid premises is zoned C-4 Regional Commercial District under the zoning ordinance of the City of West Allis, which permits the location of a restaurant with drive-thru as a special use, pursuant to Sec. 12.43(2) of the Revised Municipal Code.

5. The property is serviced by all necessary public utilities.
